OTHER INSURANCE

Other insurance defense areas include employment practices, liability, surety matters, subrogation, and coverage.

Employment Practices

We represent management in a variety of employment disputes in federal and state courts as well as in administrative agencies. These disputes include claims based on Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act and their state based counterparts, other federal statutes such as the Family and Medical Leave Act and common law claims such as wrongful discharge, breach of contract, interference with contractual relations, retaliatory discharge, intentional infliction of emotional distress, and fraud.

Insurance Coverage/ Surety/ Subrogation

BDCR's insurance litigation group represents insurance companies in resolving complex coverage issues. Many of these issues arise from the alleged failure to defend under liability policies or out of a failure to settle claims that result in bad faith litigation. Directors and officers, professional liability and construction liability policies are the primary areas of concentration.
